Terms of Service

The Pet Stop Mobile Clinic-Pet Stop + Wellness provides a subscription service for unlimited wellness services for your dog or cat (which include: Nail Trim, Anal Gland Expression, Dental Rinse, and Ear Cleaning (ear cleaning for dogs only) 10% off Dog/Cat Pack A, 10% off of a year supply of prevention and 1 free Basic Wellness Exam. Use of the Services is subject to these Terms and Conditions and The Pet Stop Mobile Clinic-Pet Stop + Wellness Membership Privacy Policy. YOU MAY CANCEL AT ANY TIME. 

Acceptance of Terms

By subscribing to our Services, you indicate your unconditional acceptance of the following Terms and Conditions. 

Registration and Membership

In order to start your ongoing membership monthly subscription, you must register as a member. To register, you can simply provide information about your pet and services you require, your information including address and billing and credit card information, and your valid email address and information about your pet. All information that you provide to The Pet Stop Mobile Clinic, including your credit card information, is subject to The Pet Stop Mobile Clinic-Pet Stop + Wellness Membership’s Privacy Policy. You are responsible for keeping your registration information up to date. 

As a registered user of The Pet Stop + Wellness Membership, you agree to receive emails promoting any special offers. We may from time to time send you our monthly newsletter. You may opt-out from receiving special promotions or our newsletter by emailing info@petstopclinic.com or selecting to unsubscribe as may be provided in the applicable e-mail correspondence.

Subscription

1.       As a subscribed member, each month you will have access to unlimited wellness services of your choosing. BY SUBSCRIBING YOU AGREE TO PAY THE MONTHLY SUBSCRIPTION FEE FOR THE SERVICES THAT YOU SIGNED UP FOR. This agreement is not transferable or assignable and applies only to the pet designated while owned by the client. Client may obtain care for pet under this agreement only at The Pet Stop Mobile Clinic at participating retail locations, Excludes Pet Supplies Plus and home visits. Either The Pet Stop Mobile Clinic or Client may cancel this agreement at any time. Your subscription is continuous until you cancel. If client cancels for any reason The Pet Stop Mobile clinic shall be entitled to retain and charge the installment for the month in which the cancellation occurs. If Client has paid the full annual fee in advance, upon cancellation by Client, The Pet Stop Mobile Clinic will refund the monthly installments for the remaining months after the month in which cancellation occurs. If Client performs all his or her obligations and The Pet Stop Mobile Clinic cancels the agreement, all monthly or annual fees client has paid for the current term year will be refunded in full, less The Pet Stop Mobile Clinics full retail charges for any services rendered before cancellation. In no case will any amount paid by client be refunded upon cancellation.

Client understands and agrees that no additional incentives will be offered when rendering the services in this agreement, including but not limited to gift cards, discounts, bundle packages, rebates or other forms of financial gain will be included whatsoever when redeeming services.   

This agreement will be effective for the period client signs up and will be automatically renewed for subsequent periods of one year unless and until client or The  Pet Stop Mobile Clinic terminates this agreement as of the end of any term year by written notice to the other party given no less than 30 days prior to the automatic renewal date. The Pet Stop Mobile Clinic reserves the right to adjust monthly fees and services at any anniversary date or to cease at any time to provide the program. Client will be notified of any adjustments 30 days in advance via email.

Installment payments will be billed directly to your credit card. Client is responsible for notifying The Pet Stop Mobile Clinic of any changes in account setups for billing. In the event the Client fails to pay any installment within 30 days of its due date, The Pet Stop Mobile Clinic may immediately terminate this agreement and declare all fees and remaining monthly installments for the then current term year to be immediately due and payable. 

2.       If any cancellation of this agreement for any reason results in monies due to either Client or The Pet Stop Mobile Clinic such monies will be paid in full within 30 days of cancellation.   

Billing and Payments

The price of the Services is payable in full each month. We accept the following credit cards at this time: Visa, MasterCard, American Express, or Discover. You will automatically be charged each month for your ongoing subscription. YOU MAY CANCEL AT ANYTIME. You will automatically be charged each month during that subscription period. Further, unless you cancel your subscription or membership prior to the end of your then-current subscription period, at the end of that period, your subscription will automatically be renewed for an additional subscription period of the same amount of time.

For your convenience and continuous subscription benefits as a member, if your payment method reaches its expiration date, you do not edit your credit card information and you have an ongoing subscription, you authorize us to continue billing that credit card on file including extending the expiration date until we are notified by you or the credit card company that the account is no longer valid. We encourage you to update your payment method information or cancel your membership should you wish to discontinue your monthly purchase of products and services.

We use a third party payment service in lieu of directly processing your credit card information. By submitting your credit card information, you grant The Pet Stop Mobile Clinic Membership the right to store and process your information with the third party payment service, which it may change from time to time; you agree that The Pet Stop Mobile Clinic Membership will not be responsible for any failures of the third party to adequately protect such information. All financial matters regarding your information are subject to the conditions of the third-party payment service provider’s terms of service. You acknowledge that we may change the third-party payment service and move your information to other service providers that encrypt your information using secure socket layer technology (SSL) or other comparable security technology.

Limitation of Liability

IN NO EVENT SHALL THE PET STOP MOBILE CLINIC HOLDING LLC MEMBERSHIP OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE TO MEMBER/SUBSCRIBER OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, OR COSTS OF OBTAINING SUBSTITUTE GOODS OR SERVICES) ARISING OUT OF THE USE, INABILITY TO USE, UNAUTHORIZED ACCESS TO OR USE OR MISUSE OF THE SERVICES OR ANY INFORMATION CONTAINED THEREON, WHETHER BASED UPON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES.

YOU AGREE THE PET STOP MOBILE CLINIC HOLDING LLC MEMBERSHIP’S TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH THESE TERMS AND CONDITIONS OR SERVICES WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE PET STOP MOBILE CLINIC MEMBERSHIP IN THE THEN-PRIOR CALENDAR MONTH.

Indemnification

By using our Services you agree to indemnify, hold harmless and defend The Pet Stop Mobile Clinic Holding LLC from any claims, damages, losses, liabilities, and all costs and expenses of defense, including but not limited to, attorneys’ fees, resulting directly or indirectly from a claim by a third party that arises in connection with use of Services, or Products by you or any other person accessing the services.

Minors

The Pet Stop Mobile Clinic Membership services are available only to, and may only be used by, individuals who are 18 years and older who can form legally binding contracts under applicable law. Individuals under the age of 18 can use this service only in conjunction with and under the supervision of a parent or legal guardian. In this case, the adult is the user and is responsible for any and all activities, subscribers and purchasers.

Disclaimer of Warranty

YOU ARE SOLELY RESPONSIBLE FOR DETERMINING IF THE SERVICES ARE SUITABLE FOR YOUR PET. WE ARE NOT ABLE TO PROVIDE ANY ASSURANCES REGARDING ALLERGIES AND OR ANXIETY OR BEHAVIORAL ISSUES. Under no circumstances will we be liable for any loss or damage caused by your use of the Services 

Enforcement

These Terms and Conditions shall be governed and interpreted pursuant to the laws of the State of Florida, United States of America, notwithstanding any principles of conflicts of law.

All disputes arising out of or relating to these Terms and Conditions shall be finally resolved by arbitration conducted in the English language in Miami FL, U.S.A. under the commercial arbitration rules of the American Arbitration Association. The parties shall appoint as sole arbitrator a retired judge who presided in the State of Florida. The parties shall bear equally the cost of the arbitration (except that the prevailing party shall be entitled to an award of reasonable attorneys’ fees incurred in connection with the arbitration in such an amount as may be determined by the arbitrator). All decisions of the arbitrator shall be final and binding on both parties and enforceable in any court of competent jurisdiction. Notwithstanding the foregoing, we shall be entitled to seek injunctive relief, security, or other equitable remedies from federal and state courts located in the State of Florida or any other court of competent jurisdiction. Under no circumstances shall the arbitrator be authorized to award punitive damages, including but not limited to federal or state statutes permitting multiple or punitive damage awards. Any purported award of punitive or multiple damages shall be beyond the arbitrator’s authority, void, and unenforceable. BY AGREEING TO THESE TERMS OF SERVICE, YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO HAVE A COURT HEAR CLAIM ARISING IN CONNECTION WITH THIS AGREEMENT, AMONG OTHER WAIVERS OF RIGHTS SET FORTH IN THIS AGREEMENT.

Severability

To the extent you are located in the United States, if any provisions of this Agreement are not permitted by applicable law or regulation, those provisions shall be of no force or effect as between you and The Pet Stop Mobile Clinic Holding LLC. If any part of these Terms and Conditions is held to be unlawful, void, or unenforceable, that part will be deemed severable and shall not affect the validity and enforceability of the remaining provisions as between you and The Pet Stop Mobile Clinic Holding LLC.

Entire Agreement

These Terms and Conditions constitute the entire agreement between the parties relating to the subject matter herein. We may, at our sole discretion and without notice, revise these terms at any time by updating this posting.
